Starting October 31, 2010, Michigan drivers who are arrested with a blood alcohol content of .17 or higher faces the potential of enhanced sentences and license sanctions.

Treatment Program
This new law requires anyone convicted under the "super drunk" statute to complete a one year treatment program. The traditional drunk driving offense has no required treatment program. This can be found at MCL 257.625(1)(c). Link: http://legislature.mi.gov/doc.aspx?mcl-257-625-amended

Fines and Jail Time
The "super drunk" statute also allows the court to give a increased maximum fine of $700, up from the traditional $500, and potential jail time of 180 days, up from the usual 93 days. This can be found at MCL 257.625(5). Link: http://legislature.mi.gov/doc.aspx?mcl-257-625-amended

License Sanctions
If an individual is convicted of this new statute the Michigan Secretary of State will suspend their license for one year with the following provisions:

An offender will completely lose their driver's license for the first 45 days. This is a hard suspension so absolutely no restricted driver's license is available during this first 45 days. For the remaining 320 days the offender will be allowed a restricted driver's license only if they install an ignition interlock device in their automobile.
